Terms of Use Agreement

These Terms of Use (the "Terms") constitute a legally binding agreement between you ("User" or "you") and Roze ("Company," "we," "us," or "our") regarding the use of Roze Messaging (the "Application"). By accessing or using the Application, you agree to be bound by the terms and conditions of these Terms. If you do not agree with these terms, please do not use Roze Messaging.

1. Acceptance of Terms

By using Roze Messaging, you agree to comply with and be bound by these Terms of Use and our Privacy Policy. If you do not accept these terms, you must not use Roze Messaging.

2. Changes to the Agreement

We reserve the right to modify or revise these Terms at any time, and such changes will be effective immediately upon posting the revised Terms on Roze Messaging. It is your responsibility to regularly review these Terms to stay informed about any updates.

3. Use of the Application

• You must have a valid phone number to use Roze Messaging for authentication.
• You agree to use Roze Messaging only for lawful purposes.
• You will not engage in any activity that interferes with the functionality or security of Roze Messaging.

4. Intellectual Property

Roze Messaging and its original content, features, and technology are owned by Roze and are protected by intellectual property laws. You agree not to reproduce, distribute, or create derivative works from any content on Roze Messaging without our express written permission.

5. Confidentiality and Data Encryption

The messages and content you send and receive through Roze Messaging are end-to-end encrypted, ensuring the confidentiality and security of your communication. However, if a message is reported, please be aware that it may be shared with the Roze team unencrypted for the purpose of managing the report.

6. Use of the OpenAI API

We use the OpenAI API to generate content created by artificial intelligence (AI) in Roze Messaging. By using our Application, you agree that your interactions with the AI are subject to OpenAI's terms of use.

7. Data Collection and User Behavior Tracking

We use Amplitude to collect data and track user behavior to enhance our services. The data collected is anonymous and used solely for the purpose of improving our services. Our data collection complies with European data protection regulations, including the General Data Protection Regulation (GDPR), and we are committed to respecting the rights and protections of users under these regulations.

8. User Accounts

• You must have a valid phone number to create an account for authentication purposes.
• You are responsible for maintaining the confidentiality of your account information.
• You are responsible for any activity on your account.

9. Termination

We reserve the right to terminate or suspend your account and access to Roze Messaging for any reason, without notice.

10. Limitation of Liability

Under no circumstances will Roze be liable to you for indirect, consequential, special, punitive, or incidental damages.

11. Applicable Law

These Terms are governed by French law. Any dispute arising from these Terms will be subject to the exclusive jurisdiction of the French courts.
